“Employee Profiles” means the profile created by employees that may include personal information and photo.
4.
“Company Profiles” means profile created by Employers.
5.
“Medical Centres” means a health care organization in which health care, research, staff support and ancillary services are provided.
6.
“User” refers to any individual or entity that uses any aspect of the SwipeWorkers.com Website and/or SwipeWorkers.com Services.
7.
“SwipeWorkers.com Content” includes all text, graphics, design, programming, information, images, video, audio files, software and other contents used on the SwipeWorkers.com Website.
8.
“SwipeWorkers.com Database” or “SwipeWorkers.com Databases” includes all employees and/or employers’ information registered with SwipeWorkers.com.
9.
SwipeWorkers.com Services” means any services provided by SwipeWorkers.com including:-

the provision of candidates/employees online portal;
2.
matching of job specifications with potential candidates/employees profiles;
3.
booking of medical appointments with healthcare providers
4.
applying/renewing Visa or Passport or Work Permit
5.
online loan application
6.
online money transfer to Indonesia

“User Content” means all information, data, text, software, music, sound, photographs, graphics, video, advertisements, messages or other materials submitted, posted or displayed by Users on or through SwipeWorkers.com Website.

“You” or “you” means the person who (or the entity on behalf of whom you are acting) that is agreeing to these Terms.

To register on the SwipeWorkers.com Website you must be 18 years of age or above.

You must ensure that the details provided by you on registration or at any time are correct and complete.

All Users agree to not:-
1.
transmit, post, distribute, store or destroy material, including without limitation SwipeWorkers.com Content, in violation of any applicable law or regulation, including but not limited to laws or regulations governing the collection, processing, or transfer of personal information, or in breach of SwipeWorkers.com’s Privacy Policy;
2.
violate or attempt to violate the security of any SwipeWorkers.com Website;
3.
aggregate, copy or duplicate in any matter any of the SwipeWorkers.com Content or information available from any SwipeWorkers.com Website,

5.

attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to any SwipeWorkers.com Website, overloading, “flooding”, “spamming”, “mailbombing”, or “crashing”.
14.
use the SwipeWorkers.com Services for any unlawful purpose or illegal activity, or post or submit any content, profile, resume, or job posting that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, harassing, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by SwipeWorkers.com’s discretion.
9. Additional Terms applicable to Employers
1.
SwipeWorkers.com hereby grants you a limited, terminable, non-exclusive right to access and use SwipeWorkers.com Website for your internal business use seeking candidates for employment. This authorizes you to view and download a single copy of SwipeWorkers.com Content or materials on SwipeWorkers.com Website solely for your use directly related to searching for and recruiting Candidates.
2.
SwipeWorkers.com also grants you a limited, terminable, non-exclusive right to use SwipeWorkers.com Services for your internal use only.
3.
You are responsible for maintaining the confidentiality of your Employer account, Company Profiles and passwords, as applicable.
4.
You may not share your password or other account access information with any other party, temporarily or permanently, and you shall be strictly liable and/or responsible for all uses of your SwipeWorkers.com Website registrations and passwords, whether or not authorized by you.
5.
You agree to immediately notify SwipeWorkers.com of any unauthorized use of your employer account, Company Profiles or passwords.
6.
Employer represents, warrants and covenants that any Employer Materials provided by Employer for use in connection with SwipeWorkers.com Services will not violate any laws or regulations or third-party proprietary rights, including, without limitation, copyright, trade mark, obscenity, rights or publicity or privacy, and defamation laws.
7.
Employers acknowledge and agree that it shall disregard any personal data received from the Candidate which are irrelevant to obtaining and assessing the suitability of candidates.
8.
Employers are solely responsible for the Employer Materials on SwipeWorkers.com Website. SwipeWorkers.com is not to be considered to be an employer with respect to your use of any SwipeWorkers.com Website and SwipeWorkers.com shall not be responsible for any employment decisions, for whatever reasons, made by any entity posting jobs on any SwipeWorkers.com Website.
10. User Content and submissions
1.
You understand that all User Content is the sole responsibility of the person from which such User Content originated.
2.
You understand and acknowledge that all information provided by you, your SwipeWorkers.com Profile, resume, and/or account information shall be stored in SwipeWorkers.com Databases and/or SwipeWorkers.com Resume Databases.
3.
You understand, acknowledge and consent that all information provided by you, your SwipeWorkers.com Profile, resume, and/or account information may be transferred to countries outside of your location for the purposes of storing and/or processing. Please see SwipeWorkers.com’s Privacy Policy, for further details.
4.
By submitting, posting or displaying User Content on or through SwipeWorkers.com Website, you grant SwipeWorkers.com, subject to your privacy setting, a worldwide, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content through SwipeWorkers.com Website. SwipeWorkers.com will discontinue this licensed use within a commercially reasonable period after such User Content is removed from SwipeWorkers.com Website. SwipeWorkers.com reserves the right to refuse to accept, post, display or transmit any User Content in its sole discretion.

11. SwipeWorkers.com’s right to suspend or cancel your registration

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms.
2.
You can cancel your registration at any time by informing us in writing here. If you do so, you must stop using the SwipeWorkers.com Website.
3.
The suspension or cancellation of your registration and your right to use the SwipeWorkers.com Website shall not affect either party’s statutory rights or liabilities.

These Terms will remain in full force and effect while you are a user of any SwipeWorkers.com Website.

Employers to search for and evaluate job candidates;
2.
Employees to post SwipeWorkers.com Profiles and resumes and
3.
Medical Centres to retrieve bookings of medical appointments made by employees/candidates.

SwipeWorkers.com Website and SwipeWorkers.com Content may contain inaccuracies or typographical errors. SwipeWorkers.com makes no representations about the accuracy, reliability, completeness, or timeliness of any SwipeWorkers.com Website or the SwipeWorkers.com Content. The use of all SwipeWorkers.com Website and the SwipeWorkers.com Content is at your own risk.

Nothing on SwipeWorkers.com Website shall be considered an endorsement, representation or warranty with respect to any User or third party, whether in regards to its web sites, products, services, hiring, experience, employment or recruiting practices, or otherwise.

SwipeWorkers.com shall not be liable for any loss of information howsoever caused as a result of any interruption, suspension or termination of SwipeWorkers.com Services or for SwipeWorkers.com Content, accuracy or quality of information available or transmitted through SwipeWorkers.com Services.

You acknowledge and agree that it is not SwipeWorkers.com’s policy to exercise editorial control over and to edit or amend any data or contents of any emails or posting or any information that may be inserted or made available or transmitted to or from a third party in or through SwipeWorkers.com Website and/or SwipeWorkers.com Services.

16. New And Additional Services

These Terms shall be governed by the laws of Malaysia. You irrevocably consent to the exclusive jurisdiction of the courts of Malaysia and waive any jurisdictional, venue or inconvenient forum objections to such courts.

If you breach these Terms and SwipeWorkers.com chooses to ignore this, SwipeWorkers.com will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms.

SwipeWorkers.com shall not be responsible for any breach of these Terms caused by circumstances beyond its reasonable control.

If any of these Terms shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and all provision not affected by such invalidity or unenforceability shall remain in full force and effect.

SwipeWorkers.com has taken every reasonable steps to complied and will continue to comply with its obligations as a data processor arising from the data protection and privacy laws in force from time to time to the extent that those obligations are relevant to this Agreement. Further, we have taken steps to implement and shall maintain an information security program including reasonable administrative, technical and physical measures designed to secure and protect the confidentiality, integrity and availability of all Confidential Information while in such party’s possession against unauthorized, unlawful or accidental access, disclosure, transfer, destruction, loss or alteration. The term Confidential Information will not, however, include any information that identifies or directly relates to natural persons (“Personal Data”). Each party will exercise commercially reasonable efforts not to disclose any Personal Data to the other party and to restrict the other party’s access to its Personal Data, but if a party is given access to the other party’s Personal Data, the receiving party will protect such Personal Data using a reasonable standard of care.
